I am a Costs Lawyer in Melbourne, Australia starting a boutique law firm specialising in legal costs which is a highly specialised area of the law. My client's are lawyers and there are two aspects of what I do: 1. I prepare certificates of assessment for lawyers so they know how much to charge their client for work they've done in a court case/court proceeding/matter etc. For example, a lawyer will engage me to go through there file for a family law matter and I will cost the file for that period. Utilising my experience in the costs court (the court that argues what are reasonable costs for lawyers to charge their clients), I go through the file and telly up how many letters, phone calls etc were completed by the lawyer and determine how much is fair and reasonable for the lawyer to charge their client for that period/matter. I will then provide them with a certificate of assessment outlining how much I have assessed the file. This gives the client of the law firm comfort that the file has been independently assessed by an expert in the field. 2) the second aspect is where a lawyer engages me to act as an agent for their client where their client has been successful in a court proceeding. For example, if you to take someone to court (for eg. for a debt owing to you) and you win, not only will the judge order the person to pay your debt, they will also order that person pay your legal costs of taking that person to court (because why should you be out of pocket). So, I will go through the lawyer's file and prepare an itemised bill of all the work the lawyer did for that case. We will then go to the costs court and argue how much the case is worth. Usually a costs lawyer is appointed for the paying party who will prepare a notice of objections to the bill and argue that the lawyer has charged too much and that the fees are not reasonable. The costs registrar (like a judge) will then make an order for costs that the paying party has to pay. I am also engaged to argue on behalf of a paying party and to argue the costs are too high.
